Simtra’s Use of Personal Information

Simtra BioPharma Solutions and its affiliates and subsidiaries (collectively “Simtra,” “us,” “we,” or “our”) are committed to protecting your privacy. This Privacy Notice (“Privacy Notice”) describes how we use, collect, share, and protect information about you from our website or other digital or online platforms we may use (collectively the “Services”), as well as through our offline interactions with you. In some cases, Simtra may issue more specific privacy notices for some products, services, or geographies.

  • When you submit it to us via the Services, webforms, or do business with us online or offline. For example, when you “contact us,” submit feedback, request additional information about a product or service, sign up for a mailing or other type of newsletter, or reach out to us regarding a question or concern.
  • From the devices you use to access the Services, which may provide technical information to us via the following technologies:

    • Web Beacons or Pixels: Electronic images placed in the code of a webpage, application, or email that allow us to monitor things such as user activity and site traffic.
    • Tags: Pieces of code, or tags, which gather information about users. For example, tags are used on our websites to better understand online usage patterns and trends. We may also use tags in our emails or newsletters to count how many of those messages are read. 
    • Widgets: Small components embedded within our Services that enable you to use certain functionalities.
  • From our vendors and service providers, such as our web hosting partners and analytics providers, who may provide us with information about you or your use of the Services.
  • From publicly available information, including the information you post publicly on social media.

Personal Information We Collect

  • Personal contact details such as name, address, e-mail address, and telephone number.
  • Technical information such as IP address, device ID, browser information, URL prior to visiting this website, logs of which pages you visit, or items you click on.
  • Location information. Your location information may be collected in various ways depending on how you use or interact with our Services. For example, location information can be derived from your IP address, device, or country or location selection.
  • Audio, video, and pictures, including security footage from our facilities and recordings you may be included in when participating in our events.
  • Social media information. We may link to pages or accounts on third-party social media networks (“social media”), but our Services do not use social media plug-ins. If you choose to interact with us on social media, we may collect the information you publish or submit, according to the Terms of Service and Privacy Notice of the social media provider.
  • Business information. If you interact with us for business reasons, we may collect your job title, business contact details, and information about products or services you expressed an interest in or purchased from us or that we have purchased from you or your company.
    • If you use a credit card to do business with us, we will collect the information necessary to process your card payment.
  • Professional, employment, and educational information. If you are a supplier or vendor, we may collect information about your employment and educational history to conduct due diligence, as explained in the following section.
  • Criminal background. If you are a supplier or vendor, and where permitted by law, we may collect public information about your criminal history to conduct due diligence, as explained in the following section.

How We Use Personal Information

Depending on what Services you use and how you interact with us, we may use your personal information for the following purposes:

  • To fulfill business agreements with you. If you engage in business with us, we will use your personal information to enter a business agreement, receive and fulfill orders, including payment processing, shipment, and returns, and provide customer service.
  • To respond to your inquiries and provide information to you. If you send us questions, make an inquiry or a request, or ask for information, we may use your personal information to respond to you. 
  • To send you marketing information. We may use your personal information to provide you with information about Simtra, to send you marketing communications, or to enable you to participate in surveys or questionnaires. We only do this as allowed by law.   • To plan and coordinate events. We may use your personal information to invite you to sponsored events, schedule and coordinate these events, and assist with the travel arrangements associated with attending our events.
  • To administer, provide, and improve the Services. For example, we may use personal information to gather and analyze statistics regarding aggregate usage of the Services. For example, we may monitor how many users visit our websites, which components or pages are most popular, which domains you come from, which browsers you use, and how you navigate our Services. We use this information to improve the content and performance of our Services.
  • To conduct due diligence on our suppliers and vendors. If you are engaging with Simtra as a third-party commercial supplier, vendor, distributor, or agent, we may use the information you provide us and publicly available information about you to conduct due diligence to ensure compliance with applicable regulations, maintain quality control, and ensure that our partners are reputable and trustworthy. Depending on certain risk factors, this may involve processing names, contact information, employment information, criminal records, financial information, and media and social media profiles of your business, your business’s executives, senior officers, and/or beneficial owners, and their familial relations.
  • To comply with applicable laws and our legal obligations. We may use your personal information to comply with applicable laws, regulations, industry codes of conduct, and Simtra’s internal policies and procedures, including:
    • For compliance with applicable retention obligations.
    • For adverse event reporting, pharmacovigilance, product safety, and other reporting obligations.
    • To detect, prevent, or otherwise address fraud, security, or technical issues.
    • To respond to lawful requests by public authorities (e.g., to investigate fraud or respond to a government request).
    • To investigate potential breaches.
    • To protect our rights, property, safety, and those of our users.

How and When We Share Personal Information

We share personal information with our affiliates and subsidiaries for the purposes described in this Privacy Notice. We may also share your personal information with third-party service providers that we hire to perform a variety of services and functions for us, such as data storage, order fulfillment, and financial, legal, and marketing services. Your information will only be shared subject to an agreement with Simtra that permits the service provider to use personal information only to provide the agreed services on our behalf.

We also share personal information for the following purposes:

  • With a business transaction partner in the event we go through a business transition such as a merger, acquisition by another company, bankruptcy, reorganization, or sale of all or a portion of Simtra’s assets.
  • With law enforcement or governmental agencies to comply with a court order, law, or legal process, including to respond to any lawful government or regulatory request.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Simtra, our customers, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.

Google Analytics

Google Analytics uses cookies to collect data such as time of visit, website pages visited, time spent on each Simtra website page, IP address, URL, and type of operating system. Please visit www.google.com/policies/privacy/partners to learn more about how Google Analytics collects and processes personal information. You can prevent Google from collecting and processing cookie-generated data relating to your use of this website by disabling Performance Cookies in our Cookie Settings or by downloading and installing the browser plug-in available at http://tools.google.com/dlpage/gaoptout.

Embedded Videos

We may embed videos on our Services that are hosted by the third-party video provider Brightcove. If you click “play” on a video embedded within the Services, Brightcove may place tracking technologies on your device via our Services, for example, to remember where you left off in the video. Depending on where you live, we may be required to obtain your consent before this type of tracking technology is used. You can always review and adjust your cookie settings on our Cookie Settings page or change your browser’s settings. 

Sale and Sharing of Personal Information with Third Parties

We do not sell personal information for monetary or other valuable consideration. We also do not share personal information for behavioral advertising purposes, including cross-context behavioral advertising. We do not use sensitive personal information for inferring characteristics about individuals. We do not use automated processing of personal information for profiling purposes.

Do Not Track

Certain laws require us to indicate whether we honor “Do Not Track” settings in your browser concerning targeted advertising. As of the effective date of this Privacy Notice, Simtra does not respond to such signals. Instead, we adhere to the standards set out in this Privacy Notice. 

Links to Third-Party Sites

The Services may provide links to other websites or resources over which Simtra does not have control (“External Websites”). Such links do not constitute an endorsement by Simtra of those External Websites. Simtra is providing these links to you only as a convenience and is not responsible for the content of such External Websites. Your use of External Websites is subject to the terms of use and privacy policies located on those External Websites. Legal Bases to Process Personal Information

Simtra will only use or process your personal information if the use or processing is permitted by applicable privacy laws in your jurisdiction. This is sometimes referred to as having a “legal basis” to use or process your personal information. The legal basis Simtra may rely on to process your personal information may include:

  • Necessary to Perform a Contract. For example, to carry out our contractual obligations with you or your institution pursuant to a consulting, professional services, or other type of contract to supply goods or services.

International Data Transfers

Simtra is a global company with global affiliates, and therefore we use global vendors, subcontractors, systems, and applications. As a result, the personal information that we collect and process about you may be transferred, stored, or accessed in a destination outside of your country, which may have less strict or no data protection laws when compared to the laws in your country. Any transfers of personal information to Simtra affiliates or third parties outside your local country will be conducted in compliance with the international data transfer restrictions that apply under applicable data protection laws.
